Know Your Rights Under Indiana Law
Indiana's Auto Repair Claims Settlement Act (IC 27-4-1.5-8) protects vehicle owners during the insurance repair process. Here's what it means for you:
No Steering Allowed
An insurer cannot direct you to a specific body shop until they have provided you written notice outlining your rights. You choose where your car gets repaired.
Right to Choose Parts
Your insurer must give you written notice of your right to approve the type of body parts used — OEM (manufacturer), aftermarket, or used.
Written Approval Required
Insurers must give you the opportunity to indicate in writing which type of body part you approve before any repair begins.
5-Year Protection
This law applies to vehicles within 5 model years. For newer vehicles, you have the right to demand OEM parts.
